You should read through this before purchasing the personalised products and submitting any forms for our services. - Our Core Concept - Privacy Policy - Payment terms - Session Requirements - Re-scan/ Return/ Refund Policy - Digital File Release and Archive - Terms & Conditions for Gift Cards Our Core Concept We (“MY3D Printing Studio”) will explain how we (“MY3D Printing Studio”) treat the personal information (“the Personal Information that is not publicly available”) we collect from visitors (“You, Visitors”) who visit our website. We collect your personal information directly from you when you activate or use our services, interact with us, either in person, over the telephone or electronically (e.g. via websites, apps, social media posts, chats, telephone, emails and/or SMS) or as otherwise required by law. Generally, we use your Personal Information for these things: * to improve our service * to respond to inquiries * to provide the services, manufacture personalised items and post the items to customers according to customers orders * to understand our user’s experience of our sites Social Media If you log into your account with any of our sites through a social media site, we will also have access to certain information from that site, such as your name, account information and profile photo, in accordance with the site’s account verification procedures. Also, if you interact with content on our social media profiles, those social media sites may share information about you with us, including your public profile, e-mail address and friend list. If you choose to “like” or share content, information about you may be publicly displayed on the social network, depending on your privacy settings. You should review the Privacy Notice of that social media site and check your privacy settings through that site. If you post information on social media or another third-party service that references MY3D or our products and services, we may publish your post on our social media accounts or websites. Marketing Communications When you register to hold an account or become a member of any MY3D site or program, we may send you commercial electronic messages and tailored advertising if you agree to let us do so. We may send you these messages via various channels and media (including by email, SMS, phone and mail, or via advertising on certain websites and social media), but only where you have not opted out of receiving such electronic messages from that MY3D site or program in that channel. You can opt out of commercial electronic messages by using the relevant unsubscribe facility for the MY3D site or program which sent the message. The appropriate unsubscribe facility may depend on the subject of the message or the channel used to send the message. Details on how to opt out of commercial electronic messages in relation to each site or program are contained within the terms and conditions for the relevant brand or program. Information You Provide About Others The content you choose to email or provide to our service, including your photos and the information you store in your address book, may include personal information of others. Before you email or provide and/or share personal information of others through our service, please ensure that you have the consent of such persons to do so. Other Information Contained in Your Photos When you email or provide your photos to our sites, your photo content may also include related image information such as the time and the place your photo was taken, tags and similar information stored by your image capture device. If you wish to restrict the transfer of image metadata in your individual photos, please adjust the settings on your image capture device. Third-party Services We use a range of third-party services to help us 3D model, measure and manufacture the effectiveness of our products and services for you. We’re also partnered with our JDM for most of the bump sculpture and figurine orders. If you decide to use such products or services, we will share certain information about you with our partners for use as needed to enable us to fulfil your order and provide the service. If you have any questions or issues regarding our privacy policy, please don’t hesitate to contact us. Payment and Session Fee All payments are due in full at the time of online purchase. Alternatively, Customers can make appointments via email, text message or social media DM then pay at the time of the scan session if the orders require the scan session. MY3D PRINTING STUDIO reserves the right to cancel the session if Customer does not pay in full. Further, no images / products will be released to Customer until Customer's account has a zero balance. This fee covers the time and talent of Photographer, professional editing of images, basic retouching and the exquisite 3D printed personalised products of Customer's choices. The price of any product that requires a 3D scan session includes the scan session and the product. There is no extra charge for any scan session. Customers can provide their receipt number and book a scan session on the site after purchasing any product that requires a scan session. Session Requests Shall the Customer's kids and pets be under their guardian's supervision during the whole session time. Offensive costume or items, weapons, nudity, insulting poses and the items could cause any legal dispute are NOT ALLOWED in the session. If Customer has any concern, please do discuss with MY3D PRINTING STUDIO beforehand. Strongly reflective items, glasses, gauze dresses and extremely small or thin accessories need to be avoided in the session due to the effect of the printing. Re-scans / Return/ Refunds Re-scans are determined at the discretion of MY3D PRINTING STUDIO. Re-scans and refunds will not be given for poor choices of clothing, make-up, hair or by not following the recommendations of the session requests. After the confirmation of the Customer's purchase, this fee is non-refundable. Customer agrees that due to the products are personalised, MY3D PRINTING STUDIO does not accept any return except damaged or wrong products. Customers will receive a replacement or gift card credit equal to the purchase amount if they receive a damaged or wrong item. Customer agrees and understands the actual measurements of all personalised 3D figurines varies as all the measurements are calculated in ratio. There are multiple products on the site and have been noted that a 3D scan session in store is required. Customer agrees that if the product can not be produced due to the customer cannot complete a scan session in store, Customer should request a refund within 28 days after purchase whilst there will be a AUD$10 fee for each transaction. Requested Poses Customer agrees that Photographer is under no obligation to capture any specific moment or pose during the session. Customer is encouraged to provide suggestions to MY3D PRINTING STUDIO. While Photographer will try her/his best to accommodate Customer's request, Photographer has no liability for not capturing any photos by Customer's request. Subject Cooperation Customers understand it is their responsibility to manage the behaviour of the subjects in the session and will not hold Photographers liable for re-scans due to the session ending on time. Artistic Subjectiveness Customers agree and understand that the quality of a personalised designed item is entirely subjective. MY3D PRINTING STUDIO will strive to present the scan and items in a workmanlike manner, but is not required to cater to specific aesthetic preferences of Customer. Model Release Customers who purchase personalised item, provide image for creating personalised product or attend a 3D scan session in store give to MY3D PRINTING STUDIO the absolute and irrevocable right and permission with respect to the manufacture process and scans that MY3D PRINTING STUDIO has taken of them and/or their minor child and/or their pets in which he/she maybe included with others: a) To copyright the same in MY3D PRINTING STUDIO or any other name that MY3D PRINTING STUDIO may select; b) To use, re-use, publish and re-publish the same in whole or in part, separately or in conjunction with other scans or the photos of their personalised 3D figurines, in any medium now or hereafter known, and for any purpose whatsoever, including (but not by way of limitation) illustration, promotion, advertising and trade, and; Customers release and discharge MY3D PRINTING STUDIO from all and any claims and demands ensuing from or in connection with the use of the scans and the photos of personalised 3D figurines, including any and all claims for libel and invasion of privacy. 2) Postage and Collecting items after A Scan Session is Completed MY3D PRINTING STUDIO starts the process of creating the items once the Customer agrees the use of the photos and completes the payment. The processing time can take up to 28 days. Customer shall inform and provide correct information for MY3D PRINTING STUDIO to organise a delivery by AusPost whilst a AUD$10 postage may apply at the time of the scan session if Customer prefers to get the personalised item delivered. Alternatively, Customer will receive a text message when the purchased items are ready to be collected in store. Customers must show the receipt to prove the identity for the collection. 3) Liability In the event that scanner/technological materials are damaged in processing, lost through system malfunction, or otherwise lost or damaged without fault of MY3D PRINTING STUDIO. Customer agrees that an entire session may not be able to be replicated, reenacted, or repeated for the purpose of re-scan and agrees to limit MY3D PRINTING STUDIO's liability to an amount not to exceed the session fee. Customer agrees to indemnify for any liability, damage, or loss related to technological failure. MY3D PRINTING STUDIO is not responsible for any injuries inflicted upon any participating parties. Customer(s) will be responsible for their children, pets and for themselves and release MY3D PRINTING STUDIO from any claims against their person or their business. 4) Copyright MY3D PRINTING STUDIO retains all copyrights to all images created during Customer’s session. Digital files release will be included with a 3D printing procedure to a joint design manufacturer for manufacturing Customer's purchased personalised 3D printed item. The digital files of a 3D printing procedure release does not allow publication of Customer's portraits (i.e. entering in contests), selling or altering of Customer's images without MY3D PRINTING STUDIO’s written permission. It is illegal for a manufacturer to copy, scan, download, print, share, alter, or otherwise steal any image created by MY3D PRINTING STUDIO during Customer's scan session without MY3D PRINTING STUDIO's permission. This also applies to images posted in an online proofing gallery, social media or hard copy images. 5) Digital File Release and Archive All digital images will be uploaded and stored in the Cloud unless the Customer asks MY3D PRINTING STUDIO to delete the images. If Customer has asked for the deletion of his/her digital images of the 3D printed figurines, any auxiliary 3D printed product will no longer be available for purchase without a new scan. MY3D PRINTING STUDIO is not responsible for loss or damage to the digital files due to circumstances beyond MY3D PRINTING STUDIO’s control. Terms and Conditions of Gift Card Purchase An e-Gift card purchased on the site will be sent to the email that Customer provides whilst purchasing and are valid for 12 months after purchase. A physical gift card purchased in store are valid for one year after purchase. Both types of gift cards are available for products and services equal or above the amount shown on the gift cards and cannot be exchanged for cash.
